Illinois Court of Appeals Affirms Verdict Obtained by Fela Partners Against Premises Owner That Lost Surveillance Footage of Incident

Armbruster Dripps Blotevogel LLC partner Roy Dripps convinced the Illinois Court of Appeals for the Fifth District to affirm a jury’s verdict of over $500,000.00 obtained by Armbruster Dripps Blotevogel LLC partners Roy Dripps, Charles Armbruster and Michael Blotevogel against a convenience store for injuries their client suffered in a slip and fall incident. The appellate court affirmed the trial court’s decision to issue an “adverse inference” instruction, finding there was sufficient evidence the convenience store had withheld surveillance footage that would have better shown how the incident occurred. It also affirmed the trial court’s determination that there was no evidence Armbruster Dripps Blotevogel LLC‘s client was contributorily negligent.
